Welcome to DropForge. By using our service, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using DropForge ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Service.

2. Description of Service

DropForge provides a digital product delivery platform that integrates with your existing Stripe, AWS S3, and Resend accounts to facilitate the sale and delivery of digital products to your customers.

2.1 Your Responsibilities

• You are responsible for maintaining your own Stripe, AWS S3, and Resend accounts
• You must provide accurate and complete information when creating your account
• You are responsible for maintaining the security of your account credentials
• You must comply with all applicable laws and regulations when using the Service

3. Account Registration

To use DropForge, you must:

• Create an account with a valid email address
• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account

4. Subscription Plans and Billing

4.1 Plans

DropForge offers multiple subscription tiers:

• Free Plan: 20 downloads and 20 emails per month
• Pro Plan: $19/month - 1,000 downloads per month
• Business Plan: $79/month - 10,000 downloads per month

4.2 Billing

• Subscription fees are billed monthly in advance
• All fees are non-refundable except as required by law
• Overage charges apply when you exceed your plan limits
• We reserve the right to change our pricing with 30 days notice

4.3 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• You will retain access to paid features until the end of your billing period
• No refunds are provided for partial months

5. Use of Third-Party Services

DropForge integrates with third-party services that you must provide:

5.1 Stripe

• You must have a valid Stripe account
• You are responsible for all Stripe fees and compliance
• You must comply with Stripe's Terms of Service

5.2 AWS S3

• You must have a valid AWS account with S3 access
• You are responsible for all AWS storage and bandwidth costs
• You must comply with AWS's Terms of Service

5.3 Resend

• You must have a valid Resend account
• You are responsible for all Resend email sending costs
• You must comply with Resend's Terms of Service and anti-spam policies

6. Acceptable Use Policy

You agree not to use DropForge to:

• Distribute illegal, harmful, or offensive content
• Violate any intellectual property rights
• Send spam or unsolicited communications
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for any fraudulent or illegal purpose
• Distribute malware, viruses, or harmful code

7. Intellectual Property

You retain all rights to your content. By using DropForge, you grant us a limited license to store, process, and deliver your content as necessary to provide the Service.

8. Data and Privacy

Your use of DropForge is also governed by our Privacy Policy. We collect and process data as described in that policy.

9. Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• We may perform maintenance that temporarily affects availability
• We are not liable for downtime caused by third-party services (Stripe, AWS, Resend)

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• DropForge is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for losses caused by third-party service failures

11. Indemnification

You agree to indemnify and hold harmless DropForge from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you distribute through the Service

12. Termination

We may terminate or suspend your account immediately if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Fail to pay required fees
• Use the Service in a way that harms us or other users

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia.
